On March 14, 2025, the United States also passed this legislation and President Trump has signed it into law. Do the CQ and CO Modifiers Apply to All Federal Insurances
Language in the Bipartisan Budget Act of 2018 instructed the Secretary of Health and Human Services (HHS), by January 1, 2019, to establish a modifier to indicate (in a form and manner specified by the Secretary), in the case of an outpatient physical therapy service or outpatient occupational therapy service furnished in whole or in part by a PTA or OTA, that the service was furnished by a PTA or OTA. The CQ and CO modifiers were created by the Secretary of HHS and became effective with dates of service on and after January 1, 2020 for traditional Medicare outpatient therapy services.

On November 1, 2024, the Centers for Medicare and Medicaid Services (CMS) released the calendar year (CY) 2025 Medicare Physician Fee Schedule (MPFS) final rule.
